The FDA regulations on drugs do not apply if the drug is being used off label by a licensed provider in the course of clinical care. The FDA regulations only apply to research use of drugs. 21 CFR 312 would not apply to a research use of a drug if the use of the drug meets the exemption criteria. 21 CFR 50 and 21 CFR 56 would still apply.
