Under section 201(s) of the FD&C Act, and FDA’s implementing regulations in Title 21 of the
Code of Federal Regulations (21 CFR), the use of a food substance may be GRAS either
through scientific procedures or, for a substance used in food before 1958, through experience
based on common use in food. Table 1 provides regulatory citations for key regulations
implementing the GRAS provisions of the FD&C Act for substances intended for use in human
food. Table 2 provides regulatory citations for key regulations implementing the GRAS
provisions of the FD&C Act for substances intended for use in animal food.
